A judge had previously declared Kelly, 39, the sole owner of the ranch, as it fell under the prenup the exes shared.

However, she told the court in a virtual hearing on November 11 that Brandon has refused to vacate the property, reported.

The judge reportedly decided against having music manager turned rancher Brandon - who Kelly has two kids with - evicted from the premises.

A source told the outlet: “Kelly recently had a major legal setback in a bid to get Brandon evicted from the Montana property that the judge awarded soley to her.

“He has been living in it and said he doesn’t have the financial means to afford to purchase a residence of his own at this time, citing the unresolved financial aspect of their divorce.”

The insider added: “The judge sided with Brandon and ruled in his favor, the order just hasn’t been formally signed off on."

Kelly is the only title-holder of the ranch, which she bought in 2018.

Court documents exclusively obtained by The Sun show that Brandon has officially given up on showbiz life since their split to become a full-time rancher.

NASTY SPLIT

The exes' split has been anything but cordial, as there have been plenty of hurdles to jump over for the American Idol alum.

The Since U Been Gone songstress has to pay Brandon $150,000 per month in spousal support, along with around $45,000 a month for child support.

However, he will be in charge of paying for the upkeep of their Montana ranch, which costs around $81,000 a month to run.

The singer was officially granted a divorce in September.

Kelly and Brandon share two kids, daughter River Rose, six, and son Remington Alexander, four, of which the singer is now the primary caretaker.

DIVORCE FILING

The Voice coach filed for divorce in June 2020, citing "irreconcilable differences," before winning primary custody of their kids.

A the time, the court declared: The parties have a difficult time co-parenting due to issues of trust between them."

Brandon will still be able to video chat with their kids every day, and the children will be able to spend Christmas with their dad, but they will be with their mom through the New Year's holiday.

According to court documents filed in August, the singer has been legally declared single and her maiden name has been reinstated.
