KATE Gosselin claims her ex-husband Jon is a 'violent and abusive person' after their son Collin, 16, alleged he 'hit and kicked' him.
Jon has denied the claim and instead alleged , which is why he and Hannah -- the couple's other daughter who lives with her father -- are not in contact with her.
In a statement, Jon's representative said: Jon Gosselin is a loving father who has never abused his son. He has done nothing but parent his children and attempt to stay out of the public eye for years. The recent allegations were deemed unfounded by the police department and CYS within 24 hours. Kate's malicious statements are libelous and if her false accusations of abuse continue, legal action will be taken.
Kate, 45, stood behind her son Collin after he spoke about he suffered from his father.
"I am done hiding and will say this unequivocally: is a violent and abusive person," the mother of eight claimed in an interview with .
She then revealed that she "learned of this incident from CYS, and through them I was then read multiple reports – from the police report, to Collin’s statement to the police, to the account of an adult eyewitness. They were all very similar, if not identical.
"Until I receive the letter from CYS about whether they’ve deemed the allegations founded or not, it’s ongoing. My contact at CYS has not told me otherwise. If this doesn’t qualify as assault, I don’t know what does," she concluded.
However, Berks County D.A. John Adams previously told PEOPLE: “No charges or citations were filed as a result of that incident. We are not investigating at this point.”
Previously, Jon's mom has also hit out at the allegations, saying she is "appalled" by them.
Accusing Kate of physically and emotionally abusing Collin, Pamela Gosselin told The Sun in a rare exclusive interview: "I am appalled that a mother who has abused her children has the nerve to accuse Jon. She is the cause of my grandson's pain.
“She has made false statements about Jon and the very worst part is she has always been the abusive parent. Anyone who knows both Kate and Jon as parents also knows she is the perpetrator of this.
"Jon loves and adores Collin and fought years to take care of him. I am furious at Kate's lies about Jon.
This all comes after a new report claimed that Jon, 43, .
In the report viewed by PEOPLE, the allegation was: "causing bodily injury to a child through recent act/failure to act: hitting/punching."
PEOPLE claimed that while Jon was not named as the alleged perpetrator, Collin alleged his father "beat" him in a now-deleted Instagram post.
The outlet claimed the post read: "My dad is a liar. Yesterday he beat me up and thought nothing of it, he punched me in the face and gave me a swollen nose and I started bleeding. He then continued to kick me in the ribs after I was on the floor. He is a liar."
An insider reportedly said of the fight: "Collin got furious and was screaming and swearing. When they got home, he was still screaming and cursing and he went into the garage and got... a big heavy bottle of liquid – and hurled it at Jon’s car, denting it.
“Jon got out of the car enraged, put him in a headlock, punched him square in the nose, and when Collin fell to the ground, then he kicked him in the ribs," the insider alleged, according to PEOPLE.
Collin allegedly called authorities, who responded to the incident.
A source close to Jon told The Sun: "Jon is a great father and has done nothing but fight for Hannah and Collin's safety. He has never abused his children."
The Lower Heidelburg Township Police Department and Pennsylvania Child & Youth Services declined to comment to The Sun.

"Jon has never abused Collin. No charges have been filed against him and there’s no ongoing CYS investigation," reps for Jon told The Sun.
"Collin has endured severe trauma. Jon is a loving father who has worked hard to ensure that his son gets the support and help he needs."
Kate told the outlet of the situation: “You do not punch and kick your children. You do not kick a child. I don’t want to hear any excuses from anyone, not from his father, not from local law enforcement, not from court personnel whose job is supposedly to ensure the best interests of my children.
“There is a child abuse law, PA 23, section 8i states that doing any of the following, regardless of whether it causes injury, is child abuse, and first on that list is kicking. Period."
She added of her ex-husband: "I don’t want my children around him. Enough is enough.”
She said the incident makes her “sick” to her “stomach.”
The Kate Plus 8 star continued: "I do not want this buried, swept under the rug or minimized. As a mother, I am not going to sit quietly and idly by while my child, any of my children, is assaulted by anyone, let alone their own father.
“I am spotlighting this, and I will keep shouting about it, in the hopes that the authorities and the courts will finally do the right thing. Do not return my child to an abuser’s home. Jon needs to be charged with a crime. If this were your child, would you feel okay with having it swept under the rug?”

“But now that it involves one of my children, I will not stay silent anymore. Say whatever you want about me, and I’ll stay on the high road. But you harm my children, I’m ready to fight back.
"I have always parented with my children’s best interests in mind. He parents to make himself look good. It is so sick it makes my blood boil.
“I am horrified that this man is the father of my children. I don’t want my children to be associated with someone who loses his mind because his car got dented."
