    These Terms and Conditions contain a lot of important information about your membership of The Sun Racing Members Enclosure. Please read these Terms and Conditions carefully before accepting them. If you do not accept them, please do not register as a member of The Sun Racing Members Enclosure. Registering as a member of The Sun Racing Members Enclosure will constitute acceptance of these Terms and Conditions as may be in force from time to time, including any changes notified by us to you.

    1. Contracting Parties
      1. References throughout these Terms and Conditions to “The Sun”, “we”, “our”, or “us” will refer to News Group Newspapers Limited.
      2. Reference throughout these Terms and Conditions to “you” or “your” refers to any person who is a member of The Sun Racing Members Enclosure. 
    2. Order of Priority
      1. By becoming a member of The Sun Racing Members Enclosure, you agree to be bound by these Terms and Conditions as well as The Sun’s General Terms and Conditions, and any promotional terms made available by us on The Sun Racing Members Enclosure from time to time which together shall constitute and hereinafter be referred to as the “Terms of Use”. In the event that there is any conflict or inconsistency between any of the foregoing terms, the order of precedence shall be as follows:
        1. these Terms and Conditions;
        2. The Sun’s General Terms and Conditions;
        3. Privacy Policy and Cookie Policy;
        4. any promotional terms;
        5. any other document referred to in them.
    3. Eligibility
      1. You must be at least eighteen (18) years of age to be a member of The Sun Racing Members Enclosure (the “Eligible Age”). 
      2. By becoming a member of The Sun Racing Members Enclosure, you warrant to us that:
        1. you meet the Eligible Age;
        2. you are a resident of the United Kingdom;
        3. the information which you provide when you register to as a member of The Sun Racing Members Enclosure is true, accurate and complete in all respects; and
        4. you have not at any time excluded yourself from any retail or online betting or gambling services. 
      3. We reserve the right to require you to provide us with proof of age documentation at any time and your membership may be suspended by us at any time until satisfactory proof of age documentation is produced to us by you.
    4. Registration
      1. If you have an existing Sun ID, then you should use this as part of the registration process for The Sun Racing Members Enclosure. If you do not have an existing Sun ID, then you will be asked to register as part of the registration process for The Sun Racing Members Enclosure. 
      2. You are not permitted to have more than one membership of The Sun Racing Members Enclosure at any one time and you agree and acknowledge that any and all special offers are limited to one per person unless otherwise stated by us. We reserve the right, at our discretion, to prevent you from receiving future offers if we suspect that you (or someone on your behalf) has registered more than once to The Sun Racing Members Enclosure.
      3. You must treat your login credentials to The Sun Racing Members Enclosure as confidential information and you must not disclose your login credentials to any third party. We have the right to disable, suspend or restrict any login credentials at our discretion, including if, in our opinion, you have failed to comply with any of the provisions of the Terms of Use.
      4. You should be aware that your use of The Sun Racing Members Enclosure may result in data charges depending on their own individual arrangements for internet access.
    5. Use of the Service
      1. When you become a member of The Sun Racing Members Enclosure, we will provide you with access to newsletters, racing news, tips, The Favourite, tickets, offers, competitions and advertised features. As part of The Sun Racing Members Enclosure, we may provide you with access to certain video and audio footage, photographs, text images, statistics, logos and other media and intellectual property relating to us or our licensors. All design, text, graphics, footage and the selection or arrangement thereof and all intellectual property rights (including copyright) in such content belong to us or our licensors.
      2. By becoming a member of The Sun Racing Members Enclosure, we will grant you a non-exclusive and non-transferable licence to use, view and display any published content for your personal private and non-commercial use only.
      3. You must not do any of the following:
        1. copy or redistribute any of the content on The Sun Racing Members Enclosure or any part of it;
        2. produce, re-produce, supply or otherwise exploit any content (whether audio, visual, audio-visual or otherwise) comprised in The Sun Racing Members Enclosure or any part of it or otherwise use it or any part of it for any commercial purpose whatsoever;
        3. sell or make any charge for access to The Sun Racing Members Enclosure or any part thereof;
        4. display or screen The Sun Racing Members Enclosure in public to an audience, even if no charge is made;
        5. upload or otherwise make available any part of The Sun Racing Members Enclosure via any social networking website, including, without limitation, TikTok, X, YouTube and any other platforms.
    6. Promotional Terms
      1. As a member of The Sun Racing Members Enclosure, competitions and promotional offers may be made available to you (“Promotional Offers”). All Promotional Offers will be subject to their own terms and conditions, whether promoted by us or by our third party partners (“Third Party Partners”). 
      2. Both we and our Third Party Partners reserve the right at any time to:
        1. cancel, modify or supersede a Promotional Offer at any time;
        2. immediately close a Promotional Offer, either temporarily or permanently, without prior warning
      3. Any offers made available to you by Third Party Partners via The Sun Racing Members Enclosure are organised and fulfilled by the relevant Third Party Partners which are wholly independent of us. Details of any such offers have been provided to us by the relevant Third Party Partners and while we require the Third Party Partners to ensure that they are accurate, we accept no responsibility for the reliability or accuracy of these details. Your use of any apps or website of Third Party Partners will be governed by separate terms and conditions applicable to that app or website. It is your responsibility to become familiar with such third party website terms and conditions and any policies applicable to your use thereof. 
      4. All offers made available to you via The Sun Racing Members Enclosure are subject to availability and may be withdrawn or changed without notice. 
      5. We will not be liable for any print errors, technical, hardware, or software failures of any kind, including but not limited to bank or other third party errors, or lost or unavailable network connections that may limit or prohibit your ability to participate in a promotion.
    7. Cancellation
      1. You may cancel your membership of The Sun Racing Members Enclosure either via ‘Subscription & Billing’ in My Account or by calling our Customer Services team on 0207 860 1129. Lines are open 10am to 5pm Mon-Fri & 8am to 4pm Weekends and Bank Holidays. 
      2. When you become a member of The Sun Racing Members Enclosure subject to these Terms and Conditions, you agree that we may start your membership immediately upon our acceptance of your order, the digital content will be available to you immediately, and you waive your statutory right to cancel your membership within fourteen (14) days of our confirmation email. Any notice of cancellation that you provide (whether before or after the fourteen (14) day period) will only take effect at the end of your current membership period. 
      3. Your membership will be automatically renewed at the end of your current membership period (i.e., monthly or annually).
      4. If you have a monthly membership, then you may cancel your membership not less than seven (7) days before the end of your next monthly billing date. 
      5. If you have an annual membership, then you may cancel your membership not less than thirty (30) days before the end of your next annual billing date. 
      6. Unless you cancel your membership before the relevant cancellation date (as set out at sections 7.4 and 7.5) that you wish to cancel your membership on expiry of the current term, you understand that your membership will automatically renew for the same period as your previous term and you authorise us to collect the then-applicable membership fee from the payment card we have on record for you. Your initial purchase of The Sun Racing Members Enclosure is an authorisation for us to use this payment card. 
      7. On renewal of your membership, your membership fee may increase if we change our prices. Changes to your membership fee will not take effect until after the end of your current membership period.
      8. We cannot give any refunds or credit for any partial months.
    8. Termination
      1. We will have the right to terminate the contract:
        1. if you breach any of the Terms of Use, in which case we shall be entitled to terminate with immediate notice at any time and we will have no liability to refund any money that you have already paid to us; and
        2. if we cease to operate  The Sun Racing Members Enclosure for any reason, in which case we shall be entitled to terminate on 30 days' notice.  
      2. If we terminate the contract or if you cancel your membership to The Sun Racing Members Enclosure, we will be entitled to discontinue your access to The Sun Racing Members Enclosure.
    9. Disclaimer
      1. We are providing The Sun Racing Members Enclosure on an "as is" basis and make no representations or warranties of any kind with respect to The Sun Racing Members Enclosure or its content, save to the extent required by law. All benefits made available to you via The Sun Racing Members Enclosure are also provided “as-is” and as available and we make no representations or warranties of any kind relating to such benefits.
      2. Any racing information and/or betting tips are provided for entertainment purposes only and no liability of any sort, financial or otherwise, is assumed by The Sun or any connected company or party for any reliance that you place on any such racing information and/or betting tips published on The Sun Racing Members Enclosure. 
      3. To the extent permissible by law, we are not responsible for any loss or damage resulting from your use of The Sun Racing Members Enclosure, attendance at an event organised through The Sun Racing Members Enclosure or from the conduct of any other members, whether online or offline. 
      4. All promotional offers made available to you on The Sun Racing Members Enclosure shall be subject to the relevant terms and conditions of that promotion, whether promoted by The Sun or by any of its Third Party Partners. We have no control over the contents of any third party websites or apps, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you participate in a third party offer or link to any third party websites or apps, you do so entirely at your own risk.
    10. Indemnity
      1. You hereby fully indemnify us on demand against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of by you (or any other person who may access The Sun Racing Members Enclosure using your login credentials) of the Terms of Use or any other liabilities which we or any of our licensors may suffer or incur arising out of your or their unlawful or improper use of or access to The Sun Racing Members Enclosure.

    12. General Terms
      1. We may amend these terms and conditions at any time and any material changes will either be notified to you by email or will be displayed on The Sun Racing Members Enclosure. By continuing to access The Sun Racing Members Enclosure after any changes are made, you accept those changes and will be bound by them.
      2. The Sun Racing Members Enclosure is in no way sponsored, endorsed or administered by, or associated with; Apple Inc. Members are providing their information to us or our third party partners and not to Apple Inc.
      3. The Sun Racing Members Enclosure is in no way sponsored, endorsed or administered by, or associated with; Google Inc. Members are providing their information to us or our third party partners and not to Google Inc.
      4. These terms and conditions shall be governed by and interpreted in accordance with English law and members irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions.
