A MUM-of-three was furious after Tesco delivered her shopping with 17 unwanted plastic bags and now the supermarket faces £5k fine for ignoring 5p charge.
Cheryle Hibbert , from Crediton, Devon, chose to untick the “pack with bags” option, which charges 40p, in order to help the environment.
But on July 11, Tesco did not charge her for any of the seventeen "unwanted plastic bags".
Now Tesco could become the first company to be fined anything between £200 and £5,000 under the plastic bag charge law.
Writing on Facebook Cherly said: “I’m not a diehard environmentalist but, I do go out of my way to avoid contributing to the problem."
"So, when I do my online shop I, purposely and religiously, uncheck the pack with bags option, which I note carries a charge of 40p to discourage the use of plastic bags presumably.
“Why then, do I consistently have items delivered, which are wrapped in bags. Sometimes two?
A spokesman for Devon County Council said today they were investigating Cheryle's complaint.
He said: “If there is no standard charge on the customer’s bill from Tesco, Crediton, then we will refer the matter to Hertfordshire County Council."
Tesco's headquarters are in the Hertfordshire town of Cheshunt, making the county council there the "primary authority" for the supermarket.
The Devon County Council spokesman said they would ask Hertfordshire officers "to contact the store’s Head Office regarding compliance with the relevant legislation".

Tesco declined to comment on the possibility of them being fined.
A spokesman for Tesco, said: “Our colleagues packed this order with the understanding that our customer wanted their delivery in carrier bags. We are checking to see if we were correct to pack the shopping in this way.”
The law states that retailers must “charge for plastic bags used for deliveries and online sales, including click-and-collect (and similar) collections.”
