ACTOR Jamie Foxx has vowed to fight an allegation made by a woman accusing him of slapping her face with his penis during a Las Vegas party.
She told police the Ray Oscar-winner, 50, tried to get her to perform oral sex on him, and when she refused he hit her with his member.
The woman told that after the alleged assault in 2002 one of Foxx's friends asked her to leave.
The following day she went to hospital in Los Angeles with a “severe panic attack”.
The accuser claimed the MeToo movement inspired her to go to police, with the incident said to be listed as an open investigation.
This is despite the statute of limitations in Nevada being three years - meaning cases can't be prosecuted after that amount of time has passed since the alleged offence.
She claims she wanted to put it on the record in case any other women come forward with similar allegations.
But Foxx's lawyer, Allison Hart, told TMZ: “Jamie emphatically denies this incident ever occurred, and he will be filing a report with the Las Vegas Police against the woman for filing a false police report against him.
“The first time he became aware of this woman's story was when TMZ contacted his representatives about this story.
“The alleged incident was not reported to law enforcement in 2002, or at any other time in the last 16 years until last Friday, because the incident never happened.”
Foxx - who's dating Katie Holmes - will next be seen in a new version of Robin Hood, playing Little John.
