Sacked woman wins £19k and her job back after tribunal rules her menopause was a disability

An employment tribunal heard ‘the change’ had made Mandy Davies emotional and lacking in concentration at times

A SACKED court officer has won her job back after a tribunal ruled her menopause was a disability.

A judge told Mandy Davies, 45, her condition was a “disability” and ruled bosses discriminated against her because of it.

The Scottish Courts and Tribunals Service was told to reinstate her and fork out £14,000 in lost pay plus £5,000 for “injury to feelings”.

She said: “I’m delighted. All I wanted was for this to be recognised and to get back to work.

“I hope this encourages employers to find out how each worker is affected by the menopause, as the symptoms can be different.”

Last February she noticed a jug of water on her desk at Glasgow Sheriff Court had been swigged and told two participants in a civil case she feared it’d been mixed with her cystitis remedy.

A health and safety probe was launched, followed by a disciplinary investigation. Ms Davies was then dismissed for gross misconduct for “lying” about the water jug.

But after a hearing, employment judge Lucy Wiseman said the sacking was “not proportionate” and discriminated against Ms Davies “in consequence of her disability”.
