Asda home delivery driver SUES customer after claiming he was injured dropping off their shopping

He has launched legal action against shopper Brian Thompson

AN Asda shopper is being SUED by a home delivery driver who claims his THUMB was injured on the job.

Brian Thompson has been bombarded with solicitors' letters after the unnamed supermarket employee launched legal action against him.

The online shopper says he knew nothing of the alleged injury when his food shop arrived at his West Denton Park home in Newcastle.

Thompson said: “I don’t really know what happened.

“The driver parked his van, loaded the trolley, and maybe the wheel fell off, I don’t know.

“It’s the way we are living right now that a simple delivery of food could result in threats of legal action.

“Asda say he filled out an accident form on the day it happened but I was not aware of that at the time.”

Brian was “put on notice” that the lawyers would issue a pre-action disclosure application if he did not provide details of his insurers.

Although he has fully co-operated, Thompson has been left in limbo over what will happen.

Letters from the driver's lawyers claim he had suffered an injury to his left thumb and wrist with a possible scaphoid fracture.

But Thompson said the driver did not say anything at the time of the incident.

He is now warning others about the risk of online shopping.

He added: “I’m amazed and very disappointed in this response and would just like to warn other consumers of the risk they have when a driver is delivering to their property.”

A spokesman for Asda said: “Our home shopping drivers complete an extensive training programme that includes clear instructions on how to safely deliver our customers’ shopping.

“Whilst we cannot comment on individual cases or on-going legal matters we will always do our best to reach a resolution with all parties involved.

“However, if individuals take independent advice and choose to pursue a matter they are legally entitled to, we cannot influence their actions.”
