A MAN mixed his sperm with his dad's to help get his partner pregnant as they couldn't afford IVF, the High Court heard.
The couple, named as PQ and JK, agreed to the unusual procedure - resulting in the birth of a baby boy.
Although the arrangement was meant to be secret, the local council found out and ordered a DNA test to find out if PQ was the child's real dad.
But a judge at the High Court ruled against the request, saying the council had "no stake in the outcome".
Mr Justice Poole also said the family had "created a welfare minefield" but noted PQ has a bond with the boy, who is now five years old.
The judge said: "I cannot believe that JK, PQ and (his father) RS properly thought through the ramifications of their scheme for JK to become pregnant, otherwise it is unlikely that they would have embarked upon it."

He also explained the boy is a "unique child" who would not exist if it weren't for the "unusual arrangements made for his conception".
But he said "those arrangements have also created the potential for him to suffer emotional harm were he to learn of them".
Mr Justice Poole added: "It must be acknowledged that the circumstances of D's conception cannot now be undone.
"Without testing, his biological paternity remains uncertain but there is a strong chance, to say the least, that the person he thinks is his grandfather is his biological father, and that the person he thinks is his father is his biological half-brother."

The judge ended the hearing but pointing out the family could take a paternity test in the future, but "that is a matter for them".
