Couple cleared of ‘threesome grope’ in just 30 minutes angry that they were charged in the first place

A MARRIED couple accused of sex attacks on a woman after drunkenly asking for a threesome hit out yesterday when a jury cleared them in less than half an hour.

Respectable David and Sarah Finan – who have two kids – slammed the CPS for bringing the case to court and dragging their names through the mud.

Former children’s’ arts class boss Sarah, 37, and the woman had flirted and posed for photos earlier in the night while they compared boob jobs.

She and David, 41 – described as “pillars of the community” – admitted touching her intimately back at their house but both said it was consensual.

And the jury did not believe the alleged victim’s versions of events and cleared them both of assault by penetration.

The couple, of St Mary’s Island, Chatham, Kent have now been left £42,000 out of pocket due to their legal bill.

But today the pair showed their relief when the jury returned not guilty verdicts after deliberating for just 30 minutes at Maidstone crown court.

Speaking exclusively to The Sun, investment bank technology manager David said: “It should never have gone to court.

“But it did and at least we were able to have a fair trial.

“And that fair trial completely exposed really how little evidence there was.

He added: “We are just nice people and want to go back to our nice life.

“It’s been a harrowing time.”

Angry Sarah added: “We don’t want to stoop to her level. From day one of the trial it was her side.

“But the two verdicts came back within half hour, which just proves it.”

Of their legal costs, David added: “We will take the money as a hit, as lesson learnt

“We just want to put it behind us.

“It was amazing to wake up this morning and know it was the end of it.

“We are just happy it’s over. We want to get back to our family life.

“We are not looking to be revengeful.”

The two women had both previously had breast enlargements and earlier in the evening had been rubbing their breasts together and posing while David Finan took photos of them in front of other guests at their home.

Sarah told the court: “There was a lot of sexual tension by then.

“We had all had a few drinks. It had gone a bit further than comparing boobs.”

Earlier during the trial, the victim said: “That was the first time I felt uncomfortable.

“She didn’t look like she was joking.

“I had no reason to believe it would go any further. She hadn’t forced herself on me.

“I put it down to her being really drunk, crazy.”

The couple, from St. Mary’s Island, Kent, denied assault by penetration and Sarah claimed that her sexual contact with the woman was consensual.

She said: “We would not jeopardise our family – never in a million years.”

David, who denied that he and his wife were swingers, said it was the first and last time a threesome had been considered.

He said: “We are a family with two children and admittedly we wouldn’t be wanting threesomes anyway. That’s just drink.

“Certainly we have never got into threesomes with people so if we were completely sober we wouldn’t have made a decision to have a threesome on a whim.

“Me and my wife would never do anything like these allegations are stating.”

“There was a sexual thing going on between Sarah and her when they were touching each other’s breasts.

That was the build-up and it moved onto a threesome.”

David – who’d necked five pints, gin and tonic and wine – added: “This is devastating for us and we have no idea why she has made this allegation.

“The alcohol was making our inhibitions lower but all three of us were consensual.”

The investment bank technology manager said the woman had looked at him provocatively and admitted he touched her intimately for a few seconds during the evening in October 2014.

When they were alone together they kissed while he knelt in front of her and then touched her breast.

But he insisted it had come to a “natural stop” when the woman said her head was messed up and was having an affair.

He said: “She said if it had been three months earlier when she wasn’t having an affair it would have been a definite yes.”

David added that the woman had consented to intimacy and he would have stopped immediately if she had not.

He said: “This is something I would never, ever do. It’s a criminal act.

“I’m very respectful to women and I’m very respectful to my wife.”

Sarah told police: “It is not accepted that I have ever, nor would I ever, engage in any non-consensual sexual contact with another party.

“I’m extremely shocked and distressed by the allegation that has been made.”

The couple’s two children were asleep upstairs at the time.

The woman stayed at their house that night and the Finans were arrested the following morning.

They were acquitted on Monday afternoon.

A CPS spokesman said: “Having considered all the evidence in this case it was decided that there was sufficient evidence and it was in the public interest for the case to be put before a court, in accordance with the Code for Crown Prosecutors.

“No application was made by the defence to dismiss in this case. We respect the decision of the jury.”
