Aiden Fucci live updates – Tristyn Bailey ‘stabbed so viciously by suspect, 14, the buck knife blade broke,’ lawyer says

TRISTYN Bailey was allegedly "stabbed so viciously that the buck knife blade broke and stuck in her scalp," Florida State Attorney R.J. Larizza claimed.

Larizza revealed the grim details of Bailey's frenzied stabbing death last Thursday and confirmed that Aiden Fucci will be tried as an adult after he was accused of murdering the 13-year-old cheerleader.

The lawyer confirmed Bailey had 114 stab wounds – 49 of which were defensive – and that the murder weapon was found near the pond where her body was discovered.

Larizza told reporters that the blade had "broken off" after the knife was "located by the medical examiner in the scalp of our victim."

The decision to charge Fucci with first-degree murder came from a grand jury, which met in secret earlier that morning.

First-degree murder charges automatically move the case to adult court.

"The adult system is where this case belongs," Larizza said during the press conference.

The 14-year-old is 

Larizza said it "brought him no pleasure to charge a 14-year-old" with first-degree murder, but said the law and facts in the case "made it an easy decision to make."

The state attorney said it "would be an understatement to describe Tristyn's murder as horrific."

He said , with 49 of those wounds sustained to her hands and arms. Larizza described those wounds as "defensive", and said that Tristyn suffered them as she "fought for her life."

Fucci could appear in court again as early as Friday.

  • FUCCI'S FATHER PREVIOUSLY CHARGED WITH CHILD ABUSE

    Now, The Sun can reveal Fucci's father Jason, 36, has an extensive rap sheet, including a stint in jail after being charged with lewd or lascivious battery and child abuse in 2003.

    Filings obtained from Duval County Court for the first count show Fucci Sr., who was 18 at the time, was guilty of engaging in sexual activity with a 15-year-old female at his home.

    The second count showed he "did knowingly or wilfully abuse a child by intentionally committing an act that could reasonably be expected to result in physical or mental injury to a person under the age of 18 years."

    Fucci Sr. was sentenced to two years probation but was later jailed for 14 months after violating the conditions, with 158 days given as credit.

    His rap sheet also includes a number of other run-ins with the law, with charges for theft and driving with a suspended license.

    He was also booked in 2016 for battery, after cops claimed he got into a fight at a gas station with a couple while his son was present, although it is not known if this was young Aiden.

    According to documents obtained by The Sun, he was sentenced to six months probation, which was terminated early, and ordered to attend anger management classes.

    Her sister had earlier posted on social media asking for any information about the cheerleader’s disappearance.

    She wrote: “Please check your kids’ accounts for anything that can help us.

    “Help us locate our sweet sassy cheer star!! I need my blonde haired twin back.”

    A family friend wrote: "RIP sweet girl. Words cannot express our heartbreak.

    "Your life was taken tragically too soon and none of us will ever be the same.

    "Your kind spirit and infectious laugh will be remembered forever. Watch over us all beautiful angel."

  • WHEN WAS TRISTYN LAST SEEN?

    Tristyn was last seen Sunday, May 9 at roughly 1.15am near the North Amenity Center, according to reports.

    She was reported missing by her family at 10am on Sunday morning beginning a 16 hour search for the teenager.

    Her body was found later that day by a neighbor in the woods near her Durbin Crossing home.

  • TRISTYN'S FORMER CHEERLEADING COACH SPEAKS OUT

    Tanya White, who taught Tristyn cheerleading, described the tragedy as "completely horrendous" and "mind-blowing."

    Speaking on Aiden, she said: "I'm glad he has been arrested and it's moving quickly and not dragged out for the parents' sake.

    "Tristyn was a cheerleader for our middle school association and captain as a 7th grader.

    "Tristyn was an incredible leader, friend, and role model for many athletes.

    "She lit up the room with her smile and spunk! She absolutely did not deserve this.

    "The whole community and cheer world is devastated. We are all pulling together and here to support Tristyn’s family during this difficult time.";

  • TRISTYN'S COUSIN CONNIE STULL SPEAKS OUT

    Speaking exclusively to The Sun, Tristyn's cousin, Connie Stull, said she hopes Aiden confesses.

    Asked if she hopes he comes clean, she replied: "Yes I do. I have cried my eyes out.

    "I looked him [Aiden] up on Facebook, but there are too many. I'm happy they made an arrest and hope they try him as an adult.

    "Tristyn was a sweetheart, she loved cheerleading, I'm an emotional wreck, my husband and I didn't sleep well last night."

  • HOW DID FUCCI KNOW TRISTYN?

     and Tristyn Bailey both attended Patriot Oaks Academy in St Johns County.

    Patriot Oaks Academy runs from kindergarten to eighth grade and serves about 1,500 students.

    According to its website, the school contains a community that "fosters character development, independence and a lifelong love of learning."

    The school was one of two new ones to open in 2014 in St John's County. Valley Ridge Academy also launched the same year.

  • NEIGHBOR'S SURVEILLANCE FOOTAGE SHOWS FUCCI AND TRISTYN

    A neighbor’s surveillance camera also reportedly shows the same pair walking along Saddlestone Drive, close to where Bailey’s body was found, about 30 minutes later. 

    One of the people in the footage was wearing black pants and a black shirt, the same clothes Bailey was wearing when her body was found in the pond the next day. 

    The other person was wearing shorts, a light-colored hooded sweatshirt, and white shoes with a black Nike logo. 

    The arrest report said only this person was seen walking away from the area at around 3.27am carrying the white shoes in their hand. 

  • FUCCI'S SNAPCHAT FOLLOWING HIS ARREST

    As news of the murder made headlines across the US, , appearing to show him holding up a peace sign in the back of a police car.

    The caption to the image, which appeared to have been posted on Snapchat, read: "Hey guys has inybody (sic) seen Tristyn lately.”

    Police confirmed the image was being reviewed as potential evidence in the case.

    Within eight hours, Fucci, a classmate of Bailey's, was arrested by police.

    Investigators say his story has changed multiple times since the beginning of the investigation, but claim he's made a number of admissions that were verified using surveillance footage and other pieces of evidence.

    Tristyn Bailey’s family released a statement shortly after Larizza’s press conference, saying they “appreciate” the new charges against Fucci.

    “We [also] greatly appreciate the tremendous community outpouring from all parts of the world. Particularly for those in St. Johns that have helped from the Mother’s Day search, the vigils, remembrances and memorials.

    “With the press conference sharing details of this heinous crime, the caring and love shown from the people and businesses to raise up the memory of Tristyn and the resolve of our community serve as a beacon of light in the darkness.”

    The family continued: “We do ask for your continued respect for our privacy as well as of Tristyn’s teammates and her school. As we move forward, we will seek to keep Tristyn’s memory alive and the spirit of the community.”

  • PREMEDITATION OCCURRED '228 TIMES'

    "Premeditation can be inferred from just the sheer number of stab wounds that Tristyn Bailey had to suffer. Every time that arm went back, and every time that arm went down, that was premeditation ... it happened 228 times," Larizza said.

    "It's not just the fact she was stabbed 114 times - it's also information that we were able to glean from witnesses.

    "The defendant made statements to several people that he intended to kill someone. He didn't say who that was but he indicated that he was going to kill someone by taking them into the woods and stabbing them which are certainly the facts of this case."

    He later added of Tristyn: "She was fighting for her life. It's just sad that we even have to talk about that."

  • ARE THERE ANY OTHER SUSPECTS?

    On the night of Tristyn's death, Larizza says the pair had been hanging out with a few friends, before they were eventually left alone together.

    Currently, prosecutors say that have no evidence suggest that Fucci specifically targeted Tristyn.

    "This could just be a case of wrong place, wrong time," Larizza said.

    None of the others who were with the pair the night Tristyn died are suspected of wrongdoing.

    Larizza also confirmed that investigators recovered what they believe to be the murder weapon: a folding buck knife, which was recovered in a pond near to Tristyn's body.

    He said the blade was "missing a tip", which medical examiners found lodged in Tristyn's scalp.

    He is currently being held state-run juvenile detention facility in Volusia County without bond.

  • IF SENTENCED TO LIFE IN PRISON, FUCCI'S CASE TO BE REVIEWED AT AGE 25

    Prosecutors had until May 31st - or 21 days after the date of his arrest - to decide whether to try Fucci as an adult.

    Had prosecutors declined, he wouldn't have legally been allowed to be held in jail past the age of 21.

    Now Larizza says prosecutors will seek a life sentence without parole but added that Aiden would likely be able to appeal it due to a state-wide effort to reduce sentences for juveniles.

    Should he be convicted and sentenced to life, Larizza said Fucci's case would be reviewed after 25 years where a judge could either decide to reduce his sentence or release him.

  • NO EVIDENCE TO SUGGEST FUCCI SUFFERS FROM PSYCHOLOGICAL CONDITIONS

    When pressed by reporters, Larizza said there is no evidence to suggest that Fucci suffers from any psychological conditions.

    He also said that the teen had no previous criminal history.

    Larizza refused to disclose whether the killing was sexually motivated, or whether Tristyn had been sexually assaulted during the murder.

    He did however disclose that investigators found Fucci's DNA on Tristyn's body.

    They also found Tristyn's DNA on shoes and a t-shirt found in Fucci's bedroom, Larizza said.
